These digital assets include software applications, data, Short Message Service (SMS), Application Programming Interfaces (APIs), email, chat, telephone correspondence, buttons, widgets, and advertisements. Collectively, these elements will hereinafter be referred to as the “Services.” Furthermore, in this legal context, the term “Alesia Ltd websites and mobile properties” shall encompass all our online offerings.

Your use of these Services is subject to the terms, conditions, and notices set forth in this legally binding document, referred to as the “Agreement.” By accessing or utilizing our Services, you enter into a contractual relationship with Alesia Ltd and affirm that you have carefully read and comprehended the terms herein. We emphasize the importance of thoroughly reviewing this Agreement, as it outlines your legal rights, delineates their limitations, and provides guidance on applicable laws and dispute resolution mechanisms. In the event that you do not accept these terms and conditions in their entirety, you are not authorized to utilize our Services. If you currently maintain an Alesia Ltd account and seek to terminate this Agreement, you may do so at your discretion by closing your account and discontinuing any further access to or use of our Services (instructions on this process are available here).

The term “Content” in this legal context encompasses any information, text, hyperlinks, graphics, photographs, audio, videos, data, code, or other materials or combinations thereof, which are viewable, accessible, or otherwise interacted with through our Services.

References to “we,” “us,” “our,” or “Alesia Ltd” pertain to Alesia Ltd, a Delaware-based limited liability company within the United States of America. The definition of “Services” as previously elucidated pertains to offerings provided by Alesia Ltd or our corporate affiliates, collectively referred to as the “Alesia Ltd Companies.” For clarity, all the websites are owned and controlled by Alesia Ltd. Nevertheless, certain specific Services offered through these websites may be owned and controlled by corporate affiliates of Alesia Ltd, such as Services facilitating the booking of Vacation Rentals, Restaurant Reservations, and Experiences with third-party suppliers, as will be explained later in this Agreement.

As part of our Services, we may communicate with you through notifications regarding special offers, products, or supplementary services available from us, our affiliates, or our partners, which may be of interest to you. Typically, such notifications are disseminated via newsletters and marketing communications and are intended to enhance our understanding of your preferences across our Services and those offered by our affiliates. This, in turn, enables us to tailor our services to align with these preferences.

In the legal context of this Agreement, the term “you” encompasses individuals, companies, business entities, or any other legal entities making use of the Services and/or contributing Content to them. The Content that you contribute, submit, transmit, and/or post on or through the Services is collectively referred to as “your Content.”

Our Services are primarily offered for the following purposes:

Assisting customers in collecting travel-related information, posting Content, and searching for and reserving travel services and accommodations.
Assisting businesses within the travel, tourism, and hospitality sectors in engaging with existing and potential customers, through a range of free and paid-for services delivered by or through the Alesia Ltd Companies.

It is important to note that we reserve the right to amend or modify this Agreement in the future in accordance with the provisions contained herein. Your continued access or utilization of our Services following any such amendments or modifications constitutes your acceptance of the updated or revised Agreement. We will specify the date of the last revisions made to this Agreement at the conclusion of the document, and these revisions will take effect upon their publication. Registered users of our Services, hereinafter referred to as “Account Holders,” will be informed of material changes to these terms and conditions either through notification sent to the email address associated with their profile or through notices placed on our websites. We strongly recommend periodically revisiting this document to ensure familiarity with the most current version of this Agreement.

USE OF THE SERVICES

As a condition of your use of the Services, you warrant that (i) all information supplied by you via the Services to the Alesia Ltd Companies is true, accurate, current, and complete, (ii) if you are an Account Holder, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you, (iii) you are 13 years of age or older (in some jurisdictions, local laws may have an older age requirement) in order to register for an account, use the Services, and contribute to our websites, and (iv) you possess the legal authority to enter into this Agreement and to use the Services, including our websites in accordance with all terms and conditions herein. The Alesia Ltd Companies do not knowingly collect the information of anyone under the age of 13. We retain the right at our sole discretion to deny anyone access to the Services, at any time and for any reason, including, but not limited to, for violation of this Agreement. By using the Services, including any products or services that facilitate the sharing of Content to or from third-party sites, you understand that you are solely responsible for any information that you share with the Alesia Ltd Companies. You may access the Services solely as intended through the provided functionality of the Services and as permitted under this Agreement.

LINKS TO THIRD-PARTY SITES AND APPS

In the course of utilizing the Services, you may encounter links to third-party websites and applications or engage with third-party websites and applications. This may encompass the ability to share Content from the Services, including your Content, with such third-party websites and applications. It is important to note that third-party websites and applications may publicly display shared Content. Such third parties may impose charges for the use of specific content or services provided on or through their websites. Therefore, it is incumbent upon you to conduct any necessary investigations you deem appropriate or necessary before engaging in any transaction with any third party to ascertain the incurring of charges. Where Alesia Ltd provides information regarding fees or charges for such third-party content or services, such information is offered for convenience and informational purposes only. Any interactions with third-party websites and applications are undertaken at your own risk. You expressly acknowledge and consent to the fact that Alesia Ltd assumes no responsibility or liability for any such third-party websites or applications.

COMMERCIAL CONTENT AND PROMOTIONS

Certain Content that you access on or through the Services may be employed for commercial purposes. You agree and understand that Alesia Ltd may place advertisements and promotions on the Services alongside, near, adjacent, or otherwise in close proximity to your Content (including, for video or other dynamic content, before, during, or after its presentation), as well as the Content of others.

ADDITIONAL PRODUCTS

Alesia Ltd may, at its discretion, opt to modify, update, or discontinue certain products and features of the Services from time to time. You acknowledge and understand that Alesia Ltd has no obligation to store or maintain your Content or other information you provide, except to the extent mandated by applicable law.

We also offer other services that may be governed by additional terms or agreements. If you use any such services, the additional terms will be made available and will become part of this Agreement, except where such additional terms expressly exclude or otherwise supersede this Agreement. For example, if you use or purchase such additional services for commercial or business purposes, you must agree to the applicable additional terms. To the extent any other terms conflict with the terms and conditions of this Agreement, the additional terms shall govern to the extent of the conflict with respect to those specific services.

PROHIBITED ACTIVITIES

The Content and information available on and through the Services (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code, or other material), as well as the infrastructure used to provide such Content and information, are proprietary to Alesia Ltd or licensed to Alesia Ltd by third parties. With respect to all Content other than your Content, you agree not to otherwise alter, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through the Services. Additionally, you agree not to:

(i) employ the Services or Content for any commercial purpose outside the scope of those commercial purposes explicitly permitted under this Agreement and related guidelines as provided by Alesia Ltd; (ii) access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy, or otherwise exploit any Content of the Services, including but not limited to, user profiles and photos, through the use of any automated means such as robots, spiders, scrapers, or any manual process for any purpose not in accordance with this Agreement or without the express written permission of Alesia Ltd; (iii) breach the restrictions imposed by any robot exclusion headers on the Services or circumvent or bypass other measures employed to prevent or limit access to the Services; (iv) undertake any action that, at the discretion of Alesia Ltd, places an unreasonable or disproportionately large load on our infrastructure; (v) deep-link to any section of the Services for any purpose without the prior written permission of Alesia Ltd; (vi) “frame,” “mirror,” or otherwise incorporate any part of the Services into any other websites or services without the prior written authorization of Alesia Ltd; (vii) attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Alesia Ltd in connection with the Services; (viii) circumvent, disable, or otherwise interfere with security-related features of the Services or features that prevent or restrict the use or copying of any Content; or (ix) download any Content unless it is expressly made available for download by Alesia Ltd.

REVIEWS, COMMENTS, AND USE OF OTHER INTERACTIVE AREAS; LICENSE GRANT

We greatly appreciate your valuable contributions. Kindly be apprised that by providing your Content through the Services, whether it be through email, posting via any Alesia Ltd synchronization product, using the services and applications of third parties, or by any other means, including any Content transmitted to your Alesia Ltd account through any Alesia Ltd product or service, such as reviews, questions, photographs or videos, comments, suggestions, ideas, or any other materials contained within your Content, you hereby grant Alesia Ltd a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to:

(a) Host, use, reproduce, modify, execute, adapt, translate, distribute, publish, create derivative works from, publicly display, and perform your Content globally in any media, whether presently known or hereafter devised; (b) Make your Content accessible to the rest of the world and enable others to do the same; (c) Provide, promote, and enhance the Services and make your Content shared on the Services available to other companies, organizations, or individuals for syndication, broadcasting, distribution, promotion, or publication of your Content on other media and services, in compliance with our Privacy Policy and this Agreement; and (d) Use the name and/or trademark associated with your Content.

You acknowledge that Alesia Ltd may opt to attribute your Content at its discretion. Furthermore, you grant Alesia Ltd the right to pursue legal action against any person or entity that breaches your rights or the rights of Alesia Ltd in your Content due to a violation of this Agreement. It is crucial to recognize and agree that your Content is neither confidential nor proprietary. You confirm, represent, and warrant that you either own or possess the necessary licenses, rights (including copyright and other proprietary rights), consents, and permissions to publish and use your Content (and for Alesia Ltd to publish and use your Content) as authorized under this Agreement.

In the event that you retain moral rights (including rights of attribution or integrity) in your Content, you hereby declare that, to the extent permitted by applicable law:

(a) You do not demand the use of personally identifying information in connection with the Content, or any derivative works, upgrades, or updates thereof; (b) You have no objection to the publication, use, modification, deletion, and exploitation of your Content by Alesia Ltd or its licensees, successors, and assigns; (c) You forever waive and refrain from asserting any claim to moral rights as an author in any of your Content; and (d) You release Alesia Ltd and its licensees, successors, and assigns from any claims that you could otherwise assert against Alesia Ltd based on such moral rights.

It is worth noting that any feedback and other suggestions you provide may be used at any time, and Alesia Ltd is not obligated to maintain their confidentiality.

The Services may encompass discussion forums, bulletin boards, review services, travel feeds, or other forums that allow you to post your Content, such as travel experience reviews, messages, materials, or other items (“Interactive Areas”). If Alesia Ltd provides such Interactive Areas on the websites, you are solely responsible for your use of these Interactive Areas and do so at your own risk. Alesia Ltd does not ensure confidentiality with regard to any Content you provide to the Services or in any Interactive Area. To the extent that any Alesia Ltd entity provides private communication channels between Account Holders, you consent to such entity(ies) monitoring the content of such communications to help maintain the safety of our community and the Services. You understand that Alesia Ltd does not edit or control user messages posted to or distributed through the Services, including in chat rooms, bulletin boards, or other communication forums, and shall not be responsible or liable for such messaging. In particular, Alesia Ltd does not edit or control users’ Content that appears on the websites. Nevertheless, Alesia Ltd reserves the right to remove any messaging or other Content from the Services without notice when there are reasonable grounds to believe that such Content breaches this Agreement or when removal is reasonably necessary to protect the rights of Alesia Ltd and/or other Services users. If you disagree with the removal of your Content from the websites, you may contact Alesia Ltd via the Help Center to express your objections. By using any Interactive Areas, you expressly agree to submit only Content that complies with Alesia Ltd’s published guidelines, which are in effect at the time of submission and made available to you by Alesia Ltd. You expressly agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the Services any Content that:

(1) Is false, unlawful, misleading, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing (or advocates harassment of another person), threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable; (2) Is patently offensive to the online community, such as that which promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual; (3) Would constitute, encourage, promote, or provide instructions for conduct of an illegal activity, a criminal offense, give rise to civil liability, violate the rights of any party in any country or the world, or otherwise create liability or violate any local, state, national, or international law, including, without limitation, the regulations of the U.S. Securities and Exchange Commission (SEC) or any rules of any securities exchange, including, but not limited to, the New York Stock Exchange (NYSE), the NASDAQ, or the London Stock Exchange; (4) Provides instructional information about illegal activities, such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; (5) May infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party. In particular, Content that promotes an illegal or unauthorized copy of another’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files; (6) Constitutes mass mailings or “spamming,” “junk mail,” “chain letters,” or “pyramid schemes”; (7) Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity, including the Alesia Ltd Companies; (8) Contains private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers, and credit card numbers. Note that an individual’s surname (family name) may be posted on our websites, but only with the prior express permission of the identified individual; (9) Contains restricted or password-only access pages, hidden pages, or images not linked to or from another accessible page; (10) Includes or is intended to facilitate viruses, corrupted data, or other harmful, disruptive, or destructive files; (11) Is unrelated to the topic of the Interactive Area(s) in which the Content is posted; or (12) In the sole judgment of Alesia Ltd:

Violates the provisions within the preceding subsections of this Agreement.
Violates Alesia Ltd’s related guidelines as provided to you by Alesia Ltd.
Is objectionable.
Restricts or inhibits any other person from using or enjoying the Interactive Areas or any other aspect of the Services.
May expose any of the Alesia Ltd Companies or their users to any harm or liability of any type.

Alesia Ltd assumes no responsibility and disclaims any liability for any Content posted, stored, transmitted, or uploaded to the Services by you (in the case of your Content) or any third party (in the case of any and all Content more generally), or for any loss or damage thereto. Alesia Ltd is not liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity you may encounter. As a provider of interactive services, Alesia Ltd is not liable for any statements, representations, or any other Content provided by its users, including you as to your Content, in the websites or any other forum. Although Alesia Ltd has no obligation to screen, edit, or monitor any Content posted to or distributed through any Interactive Area, Alesia Ltd reserves the right, and has absolute discretion, to remove, screen, translate, or edit any Content posted or stored on the Services at any time and for any reason, or to have such actions performed by third parties on their behalf. You are solely responsible for creating backup copies of and replacing any Content you post or otherwise submit to us or store on the Services at your sole cost and expense.

Engaging in activities that violate the terms of this Agreement may lead to the termination or suspension of your rights to use the Interactive Areas and/or the Services in general.

Restricting Alesia Ltd’s License Rights: You have the option, going forward, to limit Alesia Ltd’s use of your Content under this Agreement by choosing to provide Alesia Ltd with a more restricted license, as described further below (referred to herein as a “Restricted License”). You can make this choice by selecting the Restricted License grant here (note that you must be logged into your account to do so). If you exercise this option, the rights you grant Alesia Ltd to your Content under the license terms set forth above (referred to as the “Standard License”) will be limited in several important ways, as described in the following paragraphs:

When you post your Content to the Services, the license granted to Alesia Ltd for Your Content will be restricted to a nonexclusive, royalty-free, transferable, sublicensable, and worldwide license to host, use, distribute, modify, run, reproduce, publicly display, translate, and create derivative works of your Content for the purpose of displaying it on the Services, as well as using your name and/or trademark in connection with that Content. The Restricted License applies to any of your Content, other than text-based reviews and associated bubble ratings, that you or another individual on your behalf make available on or in connection with the Services.
You can terminate Alesia Ltd’s license rights for any individual item of your Content subject to the Restricted License by deleting that post from the Services. Correspondingly, you may terminate Alesia Ltd’s license rights in all of your Content subject to the Restricted License by terminating your account. Please note that your Content may remain on the Services to the extent that you shared it with others, and they copied it or stored it before you deleted it or terminated your account. Alesia Ltd may also retain your Content for technical, fraud prevention, regulatory, or legal reasons in backup copy form for a period of time.
Alesia Ltd will not use your Content in advertisements for third-party products and services without your separate consent (including sponsored Content). However, you agree and understand that Alesia Ltd may place advertising and promotions on the Services alongside, near, adjacent, or otherwise in close proximity to your Content, including video or other dynamic content, before, during, or after its presentation, as well as the Content of others. In all instances where your Content is displayed on the Services, Alesia Ltd will provide attribution by using the name and/or trademark that you submitted in connection with your Content.
Alesia Ltd will not grant third parties the right to publish your Content beyond the Services. Nevertheless, sharing your Content on the Services, except for our “Trips” feature, which can be configured as private, will make your Content “public.” Alesia Ltd will enable a feature that allows other users to share such public Content of yours by embedding that post or by other means onto third-party services, and we will enable search engines to make that public Content findable through their services.

These restrictions are in addition to the terms and conditions set forth in this Agreement. The Content you submit to the Services in connection with other Alesia Ltd services or programs is not subject to the Restricted License but will instead be governed by the terms and conditions associated with that specific Alesia Ltd service or program.

BOOKING WITH THIRD-PARTY SUPPLIERS THROUGH Alesia Ltd

Alesia Ltd offers you the ability to search for, select, and book travel reservations with third-party suppliers without having to leave our Services. When you book travel reservations via our websites, you will automatically become an Account Holder if you are not already.

By booking via our websites, you acknowledge that you agree to abide by the practices outlined in our Privacy Policy and this Agreement. Furthermore, you represent, whether as an individual or Business Representative, that you are at least 18 years of age, possess the legal authority to enter into this Agreement, and are authorized to use the Services, including Alesia Ltd’s booking facilitation services, in accordance with this Agreement. You also confirm that all information you provide is truthful and accurate. It is your responsibility to ensure that you use Alesia Ltd’s booking facilitation services only for making legitimate reservations for yourself or on behalf of others for whom you are legally authorized to act. The creation of any false or fraudulent reservation is strictly prohibited, and any user attempting such a reservation may have their account terminated.

As a user of the Services, including Alesia Ltd’s booking facilitation services, you acknowledge and agree to the following:

Alesia Ltd and its corporate affiliates will not be liable for any unauthorized transactions made using your password or account.
Unauthorized use of your password or account could result in your incurring liability to Alesia Ltd, its corporate affiliates, and others.

When you book a reservation facilitated by Alesia Ltd, your payment information will be collected and transmitted to the supplier to complete the transaction, as detailed in our Privacy Policy. Please be aware that the supplier, not Alesia Ltd, is responsible for processing your payment and fulfilling your reservation.

Alesia Ltd will not arbitrarily interfere with reservations but reserves the right to withdraw booking facilitation services under certain exceptional circumstances. This may occur if a reservation is no longer available or if there is a reasonable suspicion that a reservation request is fraudulent. The Tripadvisor Companies also reserve the right to take steps to verify your identity to process your reservation request.

In the unlikely event that a reservation is available at the time you place an order but becomes unavailable before check-in, your only recourse will be to contact the supplier to make alternative arrangements or to cancel your reservation.

TRAVEL DESTINATIONS

International Travel with Alesia Ltd When you book international travel reservations with third-party suppliers or plan international trips using the Services, you are solely responsible for ensuring that you meet all foreign entry requirements and have all necessary travel documents, including passports and visas, in order.

For passport and visa requirements, please consult the relevant embassy or consulate for up-to-date information. It is crucial to note that requirements may change at any time, so be sure to verify the latest information before booking and departure. Alesia Ltd accepts no liability for travelers who are denied entry onto a flight or into any country due to the traveler’s failure to carry the required travel documents, as mandated by airlines, authorities, or the destination country, even if the traveler is merely passing through en route to their final destination.

Additionally, it is your responsibility to consult with a medical professional for current recommendations on necessary inoculations before traveling internationally. You must also ensure that you meet all health entry requirements and adhere to all medical guidance related to your trip.

While most travel, including to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Alesia Ltd strongly advises travelers to investigate and review travel prohibitions, warnings, announcements, and advisories issued by their government and the government of the destination country before booking international travel. Information regarding conditions in various countries and the level of risk associated with travel to specific international destinations is provided by the respective governments and authorities, including but not limited to the United States Government at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac, and www.customs.gov.

By providing information relevant to travel to particular international destinations, Alesia Ltd does not represent or warrant that travel to such destinations is advisable or without risk. Alesia Ltd is not liable for any damages or losses that may result from travel to these destinations.

LIABILITY DISCLAIMER

This section outlines limitations on the liability of Alesia Ltd for issues that may arise in connection with your use of the Services. If you do not fully understand the terms in this section or elsewhere in this Agreement, it is advisable to seek legal counsel for clarification before accessing or using the Services.

Information, software, products, and services published on or provided through the Services may include inaccuracies or errors, such as reservation availability and pricing errors. Alesia Ltd does not guarantee the accuracy of this information and disclaims all liability for any errors or inaccuracies in the information and descriptions of accommodations, experiences, air travel, cruises, restaurants, or any other travel products displayed on the Services. Alesia Ltd expressly reserves the right to correct any availability and pricing errors on the Services and on pending reservations made at incorrect prices.

Alesia Ltd makes no representations of any kind regarding the suitability of the Services, including the information contained on its websites or any portion thereof, for any purpose. The inclusion or offering of any products or service offerings on its websites or through the Services does not constitute an endorsement or recommendation of such products or service offerings by Alesia Ltd, despite any awards distributed based on user reviews. All information, software, products, and service offerings available through the Services are provided “as is” without warranty of any kind.

Alesia Ltd disclaims all warranties, conditions, or other terms of any kind that the Services, its servers, or any data (including email) sent from Alesia Ltd are free of viruses or other harmful components. To the maximum extent allowed by applicable law, Alesia Ltd hereby disclaims all warranties and conditions, including implied warranties of merchantability, fitness for a particular purpose, title, quiet possession, and non-infringement, with regard to this information, software, products, and the Services.

Alesia Ltd also explicitly disclaims any warranty, representation, or other term concerning the accuracy or proprietary character of the content available through the Services.

Third-party suppliers providing accommodations, flights, rentals, experiences, restaurants, cruises, or other travel services on or through the Services are independent contractors and not agents or employees of Alesia Ltd. Alesia Ltd is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers. Furthermore, Alesia Ltd has no liability and will not make any refund in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond its direct control. Alesia Ltd has no responsibility for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.

You use the Services at your own risk, and in no event shall Alesia Ltd, or its officers, directors, and employees, be liable for any losses or damages, whether direct, indirect, punitive, incidental, special, or consequential, or any loss of income, profits, goodwill, data, contracts, use of money, or any other loss or damages arising from or connected in any way to business interruption of any type resulting from your access to, display of, or use of the Services or with the delay or inability to access, display, or use the Services. This includes reliance upon reviews and opinions on the Services, viruses, bugs, Trojan horses, information, software, linked sites, products, and services obtained through the Services, personal injury or property damage of any nature resulting from your use of the Services’ servers and/or any and all personal information and/or financial information stored therein, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content. This applies regardless of whether the claim is based on negligence, contract, tort, strict liability, or any other theory, even if Alesia Ltd or its corporate affiliates have been advised of the possibility of such damages.

In the event that Alesia Ltd is found liable for any loss or damage arising out of or connected with your use of the Services, its liability will not exceed the greater of the transaction fees paid to Alesia Ltd for the transactions giving rise to the claim or one hundred dollars (US $100.00).

The limitation of liability reflects the allocation of risk between the parties. The limitations provided in these terms will continue to apply even if any limited remedy specified in these terms is found to have failed its essential purpose. The limitations of liability provided in these terms apply to the maximum extent allowed by your local law.

Alesia Ltd may change, suspend, or discontinue any aspect of the Services at any time, including the availability of features, databases, or content, or may impose limits or restrict your access to all or parts of the Services without notice or liability for technical or security reasons. This can also occur if Alesia Ltd believes you have breached this Agreement or that termination is necessary to protect the rights of Alesia Ltd and other users of the Services.

GENERAL PROVISIONS

We reserve the right to reclaim any username, account name, nickname, handle, or any other user identifier for any reason without liability to you.

You agree that no joint venture, agency, partnership, or employment relationship exists between you and Alesia Ltd and/or its corporate affiliates as a result of this Agreement or use of the Services.

Our performance of this Agreement is subject to existing laws and legal processes, and nothing contained in this Agreement limits our right to comply with law enforcement or other governmental or legal requests or requirements related to your use of the Services or the information provided to or gathered by us regarding such use. To the extent permitted by applicable law, you agree to bring any claim or cause of action arising from or relating to your access or use of the Services within two (2) years from the date on which the claim or action arose or accrued. Otherwise, such claim or cause of action will be irrevocably waived.

If any part of this Agreement is determined to be invalid or unenforceable according to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision. The remaining provisions in this Agreement shall continue in effect.

This Agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between you and Alesia Ltd with respect to the Services. It supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Alesia Ltd regarding the Services. A printed version of this Agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Please note that Alesia LTD does not accept legal notices or service of legal process by any means other than hard copy post delivered to the address immediately above. For the avoidance of doubt and without limitation, we therefore do not accept notices or legal service deposited upon any of our affiliates or subsidiaries.
